These Terms of Use (“Terms”) govern your access to and use of the AirSurfer website and related services (the “Platform”). By accessing the Platform or placing an order, you agree to these Terms and enter into a binding agreement with AirSurfer LLC, a Wyoming limited liability company (“AirSurfer”, “we”, “us”).

By placing an order, you confirm that you have read, understood, and accepted these Terms in full.

1. Our Role

AirSurfer provides administrative assistance and facilitation services related to travel documentation, including support in preparing and submitting visa applications and related travel documentation.

AirSurfer is not a government authority and is not affiliated with any embassy, consulate, or immigration office. We do not issue visas and we do not influence decisions made by governmental authorities.

All decisions regarding visa approval, refusal, processing times, appointment availability, or requests for additional documents are made solely by the relevant authority. We do not guarantee any specific result or processing timeline.

We are responsible for performing the services you purchase with professional care and reasonable diligence.

2. Scope of Services

When you place an order, you authorize AirSurfer to act as your disclosed agent solely for the purpose of preparing, organizing, and where permitted submitting application materials based on the information and documentation you provide.

Our services are administrative in nature. We do not provide legal advice, immigration counsel, or representation before governmental authorities.

You remain responsible for complying with entry requirements, immigration rules, passport validity standards, and the laws of your destination country.

3. Your Responsibilities

You are responsible for ensuring that all information and documents you provide are accurate, complete, and lawful. This includes passport details, personal data, travel dates, supporting documents, and declarations.

Before final submission, you must carefully review all information prepared for your application. Errors resulting from inaccurate or incomplete information provided by you remain your responsibility.

You agree to respond promptly to requests for clarification or additional documents. Delays in response may impact processing timelines or outcomes.

4. Fees and Payment

The total price of your order may include AirSurfer's service fee, government fees charged by the relevant authority, and third-party processing fees.

Government and third-party fees are generally passed through and are not retained by AirSurfer unless explicitly stated.

By completing a purchase, you authorize us and our payment service providers to charge your selected payment method.

Payment is made for the performance of administrative services. It is not a payment for a guaranteed visa outcome.

5. Commencement and Nature of Services

Visa processing services are digital and time-sensitive. Work on your order may begin shortly after payment confirmation. This may include document review, form preparation, case allocation, portal setup, and communication processing.

Service commencement may occur automatically upon payment confirmation and may include system-based or manual processing steps initiated without additional notice.

By placing an order, you acknowledge that services may commence prior to submission to any government authority and that such services may not be reversible once initiated.

AirSurfer maintains internal records of processing activity, timestamps, and communications for operational integrity, compliance, and dispute resolution.

6. Refunds

Refund eligibility depends on the type of fee and the stage of processing.

Government fees are non-refundable once paid or committed to the relevant authority, regardless of application outcome.

Third-party fees are non-refundable once incurred.

AirSurfer's service fee becomes non-refundable once substantive processing work has begun.

If an order is cancelled before processing has commenced and no external fees have been incurred, a refund of the service fee may be issued.

Visa refusals, delays by authorities, appointment unavailability, policy changes, incomplete documentation, or changes in travel plans do not create an entitlement to a refund.

Refunds, where applicable, are processed to the original payment method.

7. Payment Disputes

If you believe a charge was made in error, you agree to contact AirSurfer directly to allow us to review and resolve the matter.

In the event of a payment dispute or chargeback, AirSurfer may provide documentation of service initiation and processing activity to the relevant financial institution.

Nothing in this section limits your rights under applicable consumer protection laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, including consumer protection legislation where relevant, AirSurfer's total liability arising out of or relating to any order shall not exceed the total amount paid for that specific order, or USD $100, whichever is greater.

AirSurfer is not liable for decisions made by government authorities, including visa refusals, processing delays, appointment limitations, or additional documentation requests.

AirSurfer shall not be liable for indirect, incidental, or consequential losses, including missed travel arrangements, accommodation expenses, or business interruption resulting from visa outcomes or governmental actions.

9. Disclaimer of Warranties

The Platform and Services are provided on an “as is” and “as available” basis. While AirSurfer performs its services with professional care, we do not warrant that the Platform will be uninterrupted, error-free, or that any governmental authority will act within a particular timeframe.

10. Compliance and Integrity

AirSurfer reserves the right to refuse or cancel an order where fraudulent documentation, false information, sanctions violations, or unlawful activity is reasonably suspected.

We may conduct identity verification and compliance screening where required by law or internal risk policies.

11. Indemnification

You agree to indemnify and hold harmless AirSurfer, its officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

  • information or documentation provided by you,
  • your breach of these Terms,
  • your violation of applicable laws or regulations,
  • or your misuse of the Platform or Services.

12. Events Beyond Our Control

AirSurfer is not responsible for delays or failures caused by events beyond reasonable control, including governmental system outages, regulatory changes, strikes, natural disasters, technical disruptions, or other force majeure events.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

If a dispute arises, we encourage you to contact us first so we may attempt to resolve it informally.

If the dispute cannot be resolved informally, it shall be settled by binding arbitration administered by the American Arbitration Association before a single arbitrator, conducted in English. Arbitration may be conducted remotely where appropriate.

Either party may seek relief in small claims court where jurisdiction permits.

14. Severability and Assignment

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

AirSurfer may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.

15. Updates

We may update these Terms from time to time. The updated version will be published on the Platform with a revised effective date. Continued use of the Platform constitutes acceptance of the updated Terms.

These Terms constitute the entire agreement between you and AirSurfer regarding the Services and supersede any prior understandings or communications relating to the subject matter herein.

No oral statements, customer support communications, or prior representations shall modify these Terms unless confirmed in writing by AirSurfer.

Failure by AirSurfer to enforce any provision shall not constitute a waiver of that provision.
